Local Government

The Village operates as a statutory form of government with a mayor and six council members, each elected to four year terms.  As a statutory form of government, the rules of local government are established by the state legislature and promulgated in the Ohio Revised Code.

A Village Administrator is appointed to manage the day-to-day operations of the Village and a Fiscal Officer is employed to manage financial operations.

A five-member Planning Commission, comprised of two local officials and three citizens, is responsible for the Village's land use and zoning, and the maintenance of the Village's Comprehensive Plan.

The Village refuse hauler does not pick up Christmas trees.  The brush pile will be opened January 9, 2010 to accept the trees.

A garbage collection fee is included in your monthly utility bill. Weekly garbage collection day is Tuesday.  Each household may set out four cans or bags per week.  A piece of furniture, appliance, or rolled carpet may be included as one of your four items.  Garbage may be set out at the curb no earlier than Monday and empty receptacles shall be removed no later than Wednesday morning.

*Building materials, fiberglass tubs, yard waste, automotive parts and tires require an additional fee.  Call contractor for details.

Recyclable items, secured with red tags, are collected on the 1st and 3rd Tuesday of each month.  Tags are available at Village Hall.

Recyclable items include:

Aluminum cans, glass bottles (any color), newspapers, plastic containers (no chemical or oil containers), tin cans, cast iron tubs, dryers, hot water heaters, metal tables and chairs, microwaves, porcelain sinks, toilets, tubs, refrigerators, stainless steel sinks, washers and VCRs.


 

Public Record

Ohio Law defines public records as recorded information prepared, owned, used, in the possession of, or retained by a public body in the performance of an official function, from the time of creation or inception to final disposition.

Management of Public Records

The management of public records is a part of every public official's responsibility.  All public officials must be able to identify and protect the records that contain information the Village needs to conduct business.

Each Department Manager shall be given a current copy of the Village Public Records Policy.  When given the copy of the current Public Records Policy, each Department Manager shall sign an acknowledgement of receipt of the Policy.

Each Department Manager shall be responsible for training all subordinates within their respective divisions as to the content and form of the Village Records Policy.

Each Department Manager shall insure that a copy of the current Public Records Policy of the Village of Gibsonburg is prominently displayed for public inspection at any location where public records are housed.

The current Public Records Policy shall be included as an addendum to all employee handbooks and/or policy manuals.

 

Records Retention Schedule

All public records shall be properly maintained by the department creating said record until the records are no longer required for operational use.  Thereafter, the records will be handled in full compliance with the policy and procedures established by the Records Commission of the Village of Gibsonburg.

All Department Managers must maintain a copy of the current Records Retention Schedule and make such schedule available to any member of the general public upon request.

No Village record shall be destroyed unless the following conditions are met:

1) The public record has surpassed its retention period, in accordance with the properly established Village Records Retention Schedule.

2) The public record is listed on an Application for Disposal of Records form and submitted to the Ohio Historical Society and to the State Auditor's office.

3) Disposal of the public record is approved by the State Auditor's office.

4) The Ohio Historical Society has been allowed to review the list of records scheduled for disposal and has been given the opportunity (at least 15 business days) to select desired records for historical purposes.

Dissemination of Public Records

The personnel and officials of the Village not only have an obligation to provide for security and, where required, privacy of records held in trust of the community, but a duty to provide, upon request, copies of public records.  These records belong to the citizens.  Public personnel and officials must release records to the public, unless said records are specifically restricted by statute from public dissemination.

Each Department Manager or his/her representative shall organize and maintain public records in a manner that they can be made available for inspection or reproduction in accordance with the following:

1) PROMPT AVAILABILITY TO INSPECT.  Upon request, all public records shall be promptly prepared and made available for inspection to any person at all reasonable times during regular business hours.

2) PREPARATION OF COPIES.  Upon request, each Department Manager or his/her representative shall make copies of the requested public record available at cost, based upon the fee schedule adopted by Village Council, and within a reasonable amount of time.

3) EXEMPT INFORMATION.  If a public record contains information that is exempt from the duty to permit public inspection or to copy the public record, the Department Manager or his/her representative shall make available all of the non-exempt information.  The requester shall be informed of the redaction or the redaction shall be made plainly visible.

If a public records request is denied, in whole or in part, the Department Manager or his/her representative is required to:

1) Provide the requester with an explanation for denial, including legal authority, setting forth why the request was denied.  If the request for the record was in writing, the denial must be in writing also.

2)  Provide the requester with an opportunity to revise the request by informing said requester of the manner in which records are maintained by the office and accessed during the normal conduct of business.

3) No Village official may limit or condition the availability of public records, unless specifically required or authorized by state or federal law, by requiring disclosure of the requester's identity or the intended use of the requested record.

a) A public office or person may ask a requester to make the request in writing, may ask for the requester's identity, and may inquire about the intended use of the requested informaton, but may do so only after disclosing that this information is not mandatory.  Though this information may enhance the ability of the public office or person to identify, locate, or deliver the public records sought by the requester.

Cost of Public Record Reproduction and Transmission

Upon request, each Department Manager or his/her representative shall make copies of the requested public record available at cost, based upon the fee schedule adopted by Village Council.

Department Managers may require advanced payment for the reproduction and transmission of public records, when it is apparent that the cost of compliance will have a financial impact on operations.

1) Department Managers may require advanced payment of the cost of providing a copy of a requested public record when the record request is for a medium that cannot readily be reproduced within the Department.

2) Department Managers may require advanced payment for the cost of postage, delivery or transmission of the requested copy or copies.  The transmission of copies of requested records may be by mail or any other means of delivery or transmission.

Garage and yard sales are permitted within the Village and require the issuance of a permit.  The permit can be obtained at Village Hall and there is no fee.

Garage and yard sales can be conducted for no more than three consecutive days and can only be open for business between the hours of 9:00 am and 8:00 pm.  Residents are further restricted to holding no more than one sale a month.

 

Village Council meetings are held on the 1st and 3rd Thursdays of the month at 7:30 PM.  All meetings are open to the general public.
